Staff records and public comment on Ordinance 2026-04

The paper trail behind Ordinance 2026-04, the zoning definition amendments that changed what counts as a bedroom, a kitchen, and a dwelling and how parking is calculated: staff reports, drafts and redlines, presentations, packet materials and their transmittals, the list of properties reviewed, and all public comment, from June 1, 2025 forward.

1. Item 1. All staff reports, memoranda, analyses, ordinance drafts and redlines, presentations, and packet materials on Ordinance 2026-04 prepared for the Planning and Zoning Commission or the City Council, with their transmittals.
2. Item 2. Any list, spreadsheet, map, memorandum, complaint record, or inspection record identifying the properties that prompted, were reviewed for, or would be affected by the ordinance.
3. Item 3. Records concerning the July 10, 2025 Idaho Building Code Board proceeding at which Moscow building officials raised duplex sprinkler or life-safety concerns.
4. Item 4. All public comments the City received on the ordinance.
5. Item 5 (added July 30). The 111-plan review described at the May 13 P&Z hearing: the plans reviewed and the results. Withdrawn August 25 and refiled as request 26-897.

• Jul 23, 2026 Filed. City acknowledged receipt and gave notice of summer hours.
• Jul 28, 2026 City invoked the statutory extension under Idaho Code 74-103(2).
• Jul 30, 2026 City asked for clarification of Item 2. Requester clarified it and added Item 5.
• Aug 5, 2026 Requester asked for a fee waiver and asked the City to reconcile the City Prosecutor line on the three invoices.
• Aug 18, 2026 City granted the fee waiver: the request "addresses specific official documents that lead to the amendment of the City Code."
• Aug 27, 2026 City released eight sets of minutes (Item 4), denied Item 3 as nonexistent after City Attorney review, said Item 5 is the same document as Item 2, and closed the request. At 3:34 PM the City certified that "all records responsive to your request have been identified and included."
• Aug 27, 2026 Requester replied that the City's own minutes describe draft ordinances, staff reports, and presentations that were not in the release, and asked the City to state in writing whether it holds them.
• Aug 31, 2026 City released 46 records in three batches: Item 1 (37 files), Item 2 (1 file), Item 4 (8 files). The portal marks the request unpublished.

Folder names are the City's. There is no Item 3 folder: the City denied that item. There is no Item 5 folder: the City says Item 5 is the Item 2 spreadsheet. The July 6 Council minutes in Item 4 are the same PDF the City later produced on request 26-926.
