Should subset c also touch on the 6 unrelated allowed in certain zones? Subset c and d seem to be incompatible. 'c' would allow four people (3 related, 1 not related) and 'd' would allow an infinite number of people (unlimited related and 1 no related). • Def. 61 - consider excluding areas meeting other requirements (e.g. landscaping). • MCC 4-6-2-A-5-d/e - consider simplifying language to 'residential structure' in language addition. Consider limiting depth of tandem parking stacking. • MCC 4-6-2-E-7 - I assume that it was part of the discussion that led to the change in the residential parking standard. I am curious why it didn't go the other way, with townhomes following SFD standards. My vote would be for the SFD standards. (which would necessitate changing changes to 4-6-2-E-2) • Within the existing MCC 4-3-3 Authorized Uses, there is potentially the power for the Zoning Administrator to interpret a submitted use (or floorplan) and determine its classification (highlighted yellow, below). The next sentence regarding uses not listed could also be potentially slightly tweaked (see underline) to clarify the ZA's ability to classify an ambiguous use. Possible language (e.g. underlined below) could be added to further clarify the ZA's duty and obligation regarding use determination. An applicant who disagreed with the ZA could, of course, bring the issue before the BoA. If legal agreed, this could be a simple fix, though potentially uncomfortable for the ZA. Sec. 3-3. Authorized Uses This Zoning Code is an exclusive zoning ordinance wherein the stated uses are the only uses which are permitted in each zoning district. Those uses not listed as permitted or conditionally permitted are not authorized. The question whether a specific use is encompassed by a listed use shall be subject to the Zoning Administrator's or designee’s reasonable discretion. Further, if a proposed use is ambiguous or is not specifically listed within the Land Use Table, the Zoning Administrator or designee shall make a determination as to the zoning classification into which such use should be placed, based upon the most comparable use listed within the table. The Zoning Administrator shall have final authority regarding the classification of a use. Lucy
